Civil Service of South Sudan
The Civil Service of South Sudan refers to all employees in government and government agencies other than the security related agencies.
Civil Servants
The employees in the civil service of South Sudan are referred to as civil servants or public servants.
The civil servants are responsible for delivering public services to the public. The government of South Sudan has civil servants in its various departments and agencies for the purposes of delivering the services to the public.
Regulatory Framework
South Sudan Civil service Act of 2011
South Sudan Civil service Act provides for the regulation and governance of the Civil Service of the Government of South Sudan and to
- Provide a legal framework for the effective, affordable and fair employment and management of civil servants, officials and employees;
- Establish a civil service that is efficient and effective in the service of the government and people of South Sudan;
- establish a management framework that promotes integrity, excellent performance and merit;
- establish the rights and obligations of civil servants, officials and employees; and
- Establish principles for the remuneration of civil servants, officials and employees.
Ministry of Public Service and Human Resource Development
To build and manage the capacity of the RSS public service for effective and efficient delivery of services and where necessary regulate the operations of the private sector labour market.
Functions:
In fulfilling its mandate, the Ministry of Public Service and Human Resource Development will endeavour to establish an inclusive, impartial, responsive and efficient Public Service in a manner consistent with national priorities, values and cost-effective service delivery. This will be executed through the following core functions:
- Safeguarding and protecting the interests of employers and workers by enforcing labour and employment laws and subsidiary legislations.
- Establishing institutional arrangements for reconciliation and redress of disputes and grievances in work places.
- Formulating regulations for and supervising the formation of workers’ trade unions.
- Inspecting terms and conditions of employment to ensuring compliance with the relevant labour laws and regulations.
- Inspecting work places and promoting voluntary compliance with best practices in occupational safety and health regulations in all work places.
- Providing support and guidance to States’ Labour Offices to enable them to effectively execute their roles and functions.
- Putting concrete measures in place to eliminate child labour.
- Developing national policies aimed at promoting quality and relevant technical vocational training and building competencies needed in developing the vocational education sector in the Republic of South.
- Establishing and overseeing the operations Vocational Training Institutes nationwide.
- Regulating the employment of aliens and approving issuance of work permits.
- Determining, in collaboration with relevant Government Ministries and Institutions, organizational and structural changes needed to improve the efficiency, effectiveness and affordability of the Public Service.
- Initiating, developing, implementing and reviewing of civil service reform programmes in the Republic of South Sudan public service institutions.
- Undertaking and overseeing the appointment, conditions of service, promotions, discipline and termination of Service Personnel of the National Government.
- Creating and maintaining a human resource data-base of the National Government Public Service.
- Developing and managing the Republic of South Sudan Public Service Payroll.
- Developing policy and standard practices for records management in the public service.
- Initiating the formulation, review and implementation of National Government Public Service and Pension Laws and Regulations.
- Exercising oversight responsiblity over the management of the Public Service Pensions Funds and the Social Insurance Scheme.
- Ensuring the participation of women in the Public Service to the mandatory level stipulated in the Transitional Constitution of South Sudan.
- Providing technical assistance and other support to the States and Local Governments in order to enhance the performance of their Public Services.
- Preparing and approving the proposed personnel budgets (works pay, salaries and allowances) of all Ministries and public institutions of the RSS.
- Developing and executing a human resource development strategy for the South Sudan public service.
- Conducting training needs assessments in the national public service institutions and developing and executing appropriate interventions through training and capacity development programmes.
- Managing and coordinating public service training and capacity development programmes and activities to assure quality, timeliness, effectiveness and efficiency in the delivery and utilization of training funds.
- Installing performance management systems in the civil service.
- Establishing a public service Management Development Institute and overseeing its management.
- Establishing a credible Recruitment Board and overseeing its operations.
South Sudan Anti-Corruption Commission (SSACC)
The SSACC is an autonomous and impartial body corporate established under Section 147 of the Interim Constitution of Southern Sudan, 2005 as read with Section 6 of the Southern Sudan Anti-Corruption Act, 2009. The Commission has a mandate, inter alia, to protect public property and investigate cases of corruption with a view to protecting public property as well as in the private sector and combating administrative malpractices in public institutions.

South Sudan Civil Service Commission (SSCSC)
South Sudan civil service commission is an independent institution established under provisions of articles 143 and 144 of the interim constitution of South Sudan 2005 to advise the Government institutions on human resource practices, formulation and execution of public service laws and regulations related to employment and employees, monitor and evaluate performance of public institutions, and promote democratic principles and values to ensure equity and meritocracy in the Public Service.
Functions:
The following are the specific functions and duties of SSCSC as stipulated in the South Sudan Civil Service Commission Act, 2011.
- Investigate, monitor and evaluate the organization, administration and personnel practices of the public service;
- Propose measures to ensure effective and efficient performance within the public service;
- Give direction aimed at ensuring that personnel procedures relating to recruitment, transfer, promotions and dismissals comply with the values and principles of public service as set forth in the Constitution and section 12 below of this Act;
- Advise all Government Institutions on personnel practices, recruitment, appointment, transfer, discharge and other aspects of the public service;
- Review the terms and conditions of service, standing orders, training and qualifications for public office, personnel management, development of the public service and to make recommendations to the Government on the same;
- Guide and assist in the coordination of State civil service commissions;
- Address any imbalances in the public service;
- Scrutinize and evaluate, in conjunction with education authorities, foreign academic qualifications to determine their standards and authenticity;
- Make recommendation regarding uniform laws governing the civil service;
- Make recommendation designed to ensure that the policies connected with the terms of service, privileges and salary structure in civil service employment are implemented objectively and justly;
- Coordinate with the Ministry, other commissions; and other interested parties, in order to achieve the equitable quality standards of performance needs in the civil service;
- To recommend the principles and general policies connected with conditions of service and privileges and to submit proposal thereon to the president;
- Follow –up on the implementation of relevant policies, recruitment laws and regulations;
- Undertake research and studies on job evaluation, job grades, job specification, and performance evaluation and to issue the necessary questionnaires and forms for such purposes; and
- Publicize studies, reports, and recommendations accepted by the President in respect to the public service reform in South Sudan.
South Sudan Pensions Fund
The South Sudan Pensions Fund is the entity being created in South Sudan to administer pension funds including the Civil Service Pension Scheme. Currently draft legislation is with the National Legislative Assembly awaiting approval.
In South Sudan the civil service employees have been contributing for decades. Initially contributions were made to the National Pensions Fund in Khartoum and more recently contributions were made and held by the national and state governments of South Sudan.
